Merlok Consulting Limited (“Merlok”, “we” or the “Company”) respect the privacy rights of visitors to this Website and of customers who use the Company’s services, including but not limited to material contained in the Website from time to time and other services provided by Merlok (collectively referred to as “Services”). We endeavour to ensure that the way in which the Company may use or handle content, material and usage of personal data shall be carried out in compliance with the Personal Data (Privacy) Ordinance, Cap 486 of the laws of the Hong Kong Special Administrative Region (“PDPO”) as amended from time to time. The term “personal data” shall have the meaning ascribed to it by the PDPO.

KINDS OF PERSONAL DATA HELD

There are two broad categories of personal data held by Merlok. They are personal data contained in:

o    Customer files and records, which include records containing information supplied by visitors to our Website or otherwise voluntarily supplied to Merlok by clients or potential clients; and

o    Other records, which include administration and operational files and personal data provided to Merlok in respect of promotional, operational and administrative activities (including the personal data of service suppliers to Merlok).

PURPOSE OF COLLECTION AND USE OF PERSONAL DATA

If you are a user of the Services (“Customer”), personal data is collected from you to enable the Company to provide the Services to you. You may decline to provide the Company with the requested personal data, but in such case the Company may not be able to provide the Services to you. If you are a visitor to this Website, other than a Customer, you need not supply any personal data to access this Website. However, personal data may be collected from you if you request the Company for catalogues, other promotional brochures or materials or to provide you update on any of the Services, including extension of service coverage or plan(s) offered.

Personal data collected from you may be used by the Company for:

  • processing of your application for the Services;
  • enabling the provision of the Services to you;
  • conducting identity verification and/or credit checks at the time of your application for the Services;
  • processing of payment instructions or collection of amounts outstanding from you in relation to the provision of the Services;
  • marketing of the products and Services of the Company;
  • liaise with government and regulatory authorities as required by law;
  • protect and defend the rights of Merlok or other third parties, or to enforce the Terms of Use that apply to use of this site; and conduct other activities of Merlok required or permitted by law.

We will not transfer your personal data to others except for the specific classes of data transferees as mentioned in the “Confidentiality, Disclosure and Security of Personal Data section.

HOW WE COLLECT PERSONAL DATA 

While browsing an internet site, collection of personal data without a user’s express consent will occur. The services provided on this Website:

o    do not use IP address (Internet Protocol Addresses) to collect information. However, IP addresses are stored in navigation information;

o    use navigation data as aggregate data for statistical purposes only;

o    use cookies to improve browsing, but not for statistical purposes. You may disable the use of cookies, but this may impair your ability to browse this Website; and

o    do not use internet tags.

This Website applies the following policy to the active collection of personal data:

o    E-Mail: Data received by e-mails sent to the Website are used to reply to requests in those e-mails and are then stored for statistical purposes.

o    Mailing List: Names are included in mailing lists only if the express consent of the recipient has been obtained.

o    Registration: Data received upon completion of on-line forms are used to reply to requests for services set out in those on-line forms.

Personal data is also collected by Merlok when it receives forms, applications, correspondence and other documents from its clients and other individuals.

CONFIDENTIALITY, DISCLOUSRE AND SECURITY OF PERSONAL DATA 

All personal data collected and held by the Company will be kept confidential, but where disclosure is necessary for the Company to (a) comply with any statutory or legal obligations or requirements, or (b) provide the Services to you, or (c) carry out the original purpose, or a directly related purpose specified above, for which the personal data were collected, those data may be provided to the following parties (whether within or outside Hong Kong):

  • Competent court of law, law enforcement agencies, Office of the Communications Authority or other governmental, statutory or regulatory authorities, institutions or organizations;
  • Company’s associated company(ies), engaging in services for provision of the Services (or any part thereof); and
  • Banks, financial institutions, credit card issuing companies, debt collection agencies and other service providers involved in the sale, administration or provision of the Services (or any part thereof) (“Third Party Service Providers”).

Our Third Party Service Providers are under a duty of confidentiality and are contractually bound to use your personal data in connection with the purposes specified above, and not for their own purposes (including direct marketing). We have implemented, based upon appropriate physical, electronic and managerial measures and controls to safeguard all personal data provided by you and to secure the transmission of such data to the third parties listed above. Your personal data are only accessible by our own personnel or the personnel of the third parties listed above for the purposes specified above. Our own personnel and the personnel of the Third Party Service Providers will be instructed to observe duty of confidentiality and the terms of this Privacy Policy Statement when accessing your personal data.

Any questions, comments, suggestions or information other than personal data sent or posted to this Website, or any part of the site by you will be considered as voluntarily provided to the Company on a non-confidential and non-proprietary basis. The Company reserves the right to use, reproduce, disclose, transmit, publish and/or post elsewhere such information freely, including passing it to any associated company for example, in connection with the development, manufacturing and marketing of products and Services and to meet Customer needs.

All reasonable efforts are made to ensure that any personal data held by the Company is stored in a secure and safe place.

The Company reserves the right to charge you a reasonable fee for complying with a data access request as permitted by the PDPO.

RETENTION OF PERSONAL DATA 

Unless there is a mandatory legal requirement for us to keep your personal data for a specified period, we will only retain your personal data for as long as is necessary to fulfill the purposes specified above for which the personal data were originally collected. We will periodically redact or anonymize unnecessary personal data in our system in accordance with our internal procedures.

DIRECT MARKETING

Your name and contact details, including email address(es), service phone number(s) for the Services subscribed and phone number(s) and address(es) made known to us, collected from you may be used by us for direct marketing of the products and Services of the Company; and/or the products and services of the Company’s business partners. 

We may not so use your personal data unless we have received your consent. You acknowledge that telephone calls with our staff may be recorded and used as evidence by us without further notice.
